Doesn’t my social secretariat already do all this?
No, and that is not its role. A social secretariat calculates payroll based on the information you provide: hours worked, absences, bonuses. It does not check whether your contracts are valid, whether your work rules exist, whether your working hours comply with regulations, or whether you are entitled to a particular reduction. If it is unaware that your company has never had any staff, that this driver works night shifts, or that this candidate had been registered with Forem for over a year, the grant is never applied for. In the cases we audit, the error rarely stems from an incorrect calculation; it stems from information that was never passed on to them.
What is the difference between a compliance audit and a subsidy audit?
A compliance audit answers the question ‘Am I in order?’: contracts, work rules, working hours, remuneration, mandatory documents. It concludes with a report and a list of actions prioritised by urgency. The incentives audit answers the question ‘Have I received everything I was entitled to?’: it compares your ONSS declarations and your withholding tax returns with the reliefs to which you were entitled. The latter is free of charge, as the auditor is paid based on what they recover. The former is charged for, as it protects you rather than generating a return for you.
What documents do I need to provide?
For the subsidy audit: your payslips and the invoices or statements from your social secretariat showing the reductions applied. If you have your quarterly declarations to the ONSS (DmfA) or your withholding tax returns, please attach them; otherwise, it’s not a problem – most social secretariats do not send these to their clients. For the compliance audit, you’ll also need your contracts, your work rules and your timetables. If you’re missing a document, we’ll tell you where to find it or request it on your behalf with your consent.
How far back do you go?
Over the last three years, which is the period within which overpaid contributions can be recovered. If we identify an older error, we’ll quantify that too: where it results from a failure on the part of your social secretariat, it may form the basis of a claim against them.
What happens if you don’t find anything?
You pay nothing for the grant audit, and you keep the preliminary assessment. We check each scheme one by one and tell you which ones have been closed and why. Sometimes a grant that appears to have been overlooked turns out, after recalculating each record individually, to be of no value; we’ll let you know that too, before taking any further action.
How does the recovery process work?
Once you have given your consent, we sign a fee agreement. Depending on your preference, you can grant us power of attorney to act on your behalf with your social secretariat and the relevant authorities, or we can draft the letters for you to send to them yourself. The relevant quarters are then regularised, amended withholding tax returns are submitted, and the credits are tracked until they are offset or refunded. Where a service provider is held liable, we draft the claim. You are kept informed at every stage, and we always check that the rest of the file is in order before making any request: a claim prompts the authorities to review the entire case.
What happens in the event of a social inspection?
The inspectorate usually gives advance notice of its visit and provides a list of the documents it wishes to see: staff register, contracts, work rules, timetables, payslips, and Dimona records. We prepare this file with you, review any points that might raise questions, and support you on the day of the visit. If a correction is requested, we negotiate it and implement it. An inspection takes preparation; it is rarely a smooth experience.
I’ve just taken someone on – is it too late to apply for regional support?
It depends on the scheme and the Region. In Wallonia, the ‘Incitant Job Plus’ grant must be applied for within the month of recruitment; once this deadline has passed, the grant is forfeited without recourse. Federal reductions, on the other hand, are adjusted retrospectively in your ONSS declarations. That is why we prefer to check the candidate’s profile before signing the contract: between two candidates with equivalent CVs, one may qualify for three years’ funding whilst the other does not.
I’m in Brussels and Activa has closed down: is there anything left?
Yes. Federal measures apply in all three Regions: structural reductions, first-time hires, and withholding tax exemptions. In-company training (FPIE) and Actiris work placements are still available. It is precisely when support schemes are becoming scarcer that you must not miss out on any of those that remain.
Is my data protected?
Documents are stored in an encrypted space, hosted within the European Union, and can only be accessed by your adviser. A data processing agreement is signed with each client. At the end of the assignment, the documents are deleted on request.
